"Hot Button" Zoning Issues

Chickens on Residential Properties

Township Council is currently considering amending Hampton’s Zoning Ordinance to expand the allowance for chickens on residential properties. Under Hampton’s current Zoning Ordinance, chickens ARE allowed to be kept on residential properties as an accessory use without a permit, provided the following criteria is met (link to ordinance section: ):

  • Only allowed in the Conservation B (CB) zoning district
  • A minimum lot size of 5 acres is required
  • The use is only allowed for the personal, non-commercial use of the property
  • Any chicken coop must be at least 100’ from any property line or street boundary
  • The chickens must be kept entirely within a fence, which must be set back at least 25’ from any property line or street boundary
  • No more than 10 chickens per acre of fenced in area are permitted

As a part of the research for this topic, a survey of twelve surrounding municipalities was conducted, to compare the regulations for chickens on residential properties in the neighboring communities.  For any residents who are interested in this topic, the results of this survey are linked below:

Upcoming Meeting Schedule:

April 12, 2021 - Planning Commission Meeting (7:30 pm in the Hampton Community Center): The second draft of the proposed new chicken regulations will be reviewed by the Township Planning Commission and Land Use Administrator.  This meeting is open to the public and all are welcome to attend. This is the second review meeting for this update, and no final action or vote will be made.

Land Development Applications



The following is a list of Land Development applications that are currently under review with the Township.  Individual building permits, or building permit applications have not been included on the list.  To request information regarding any of the following applications, please contact the Land Development Office at (412) 486-0400 ext. 1327.  Please see below for a list of variance applications currently under review.

21-09 Modwash Site Plan

The applicant is proposing to construct an automatic carwash with associated parking, stormwater management, and utilities, on vacant property located at 5315 Route 8 in a Highway Commercial (HC) zoning district.  This is Lot 1 of the previously approved 5315 Route 8 Subdivision plan.

This application will be reviewed by the Environmental Advisory Council on June 7, 2021 at 7:00 pm and by the Planning Commission on June 14, 2021 at 7:30pm.  This application will be reviewed by Township Council on July 14, 2021 and July 28, 2021 at 7:30 pm.

21-10 A&D Holding Simple Subdivision

The applicant is proposing to subdivide an existing commercial lot located at 2661 Clearview Road in a Highway Commercial (HC) zoning district.  The proposed plan would create two separate lots for two commercial buildings that are currently both on the same lot.  Each lot will be over 1 acre in size and a right-of-way will be dedicated to allow access from the rear lot to Clearview Road.      

This application will be reviewed by the Planning Commission on June 14, 2021 at 7:30pm and by Township Council on July 14, 2021 and July 28, 2021 at 7:30 pm.

21-11 Cafaro Change of Use

In accordance with Section 310-63 C. of the Zoning Ordinance, the applicants, Richard Cafaro and Natalie Clarke, are requesting a Change of Use approval for the property located at 3312 Wagner Road in a Residential A (RA) zoning district, which is the location of the previously approved LMS Landscaping business.  The property owners would like to add a second use to so that they can hold educational classes related to their approved use as well as private event rentals such as weddings in a barn building. The applicant has requested a variance from the Zoning Hearing Board for the private event rental use since this is not an allowable use in the RA zoning district. 

This application will be reviewed by Township Council on June 9, 2021 and June 23, 2021 at 7:30 pm.

Variance Applications

THE ZONING HEARING BOARD WILL CONDUCT A PUBLIC HEARING ON TUESDAY, MAY 25, 2021 AT 7:30 PM, AT THE COMMUNITY CENTER TO HEAR THE FOLLOWING CASE:

CASE NO. 21-10 – The applicants, Bartley and Jackie Kennane, are requesting a variance to the Zoning Ordinance, No. 310, under TABLE A, for a proposed shed that encroaches on the required 10’ side setback by approximately 8’, on property located at 4889 Wickloe Drive in a Residential B (RB) zoning district.

 CASE NO. 21-11 – The applicant, Nick Francic, is requesting a variance to the Zoning Ordinance,  No. 310, SECTION 310-60, SUBSECTION B, PARAGRAPH 2, for a proposed detached garage that would exceed the maximum height limit by approximately 14’, on property located at 3272 Wagner Road in a Residential A (RA) zoning district.

 CASE NO. 21-12 – The applicant, PA 15 RE Investments LLC, is requesting a variance to the Zoning Ordinance, No. 310, SECTION 310-59, SUBSECTION E, PARAGRAPH 3(d.), related to a reduction in the number of bufferyard plantings on property located at 4640 Route 8 in a Highway Commercial (HC) zoning district.

 CASE NO. 21-13 – The applicants, Richard Cafaro and Natalie Clarke, are requesting a variance to Zoning Ordinance No, 310, Section 310-34, Paragraph B., related to the addition of a barn to be used for educational events and as a rental venue, on the existing commercial LMS Landscaping property, located at 3312 Wagner Road, in a RA zoning district.
